Doğadayız Day Activity Digital Service Agreement

DAY ACTIVITIES DIGITAL SERVICE AGREEMENT

This agreement is the Doğadayız Day Activity Tour Service Agreement to be organized within the year 2026, and it aims to guarantee the rights of both parties. It has been made between, on the one side, Doğadayız Doğa Sporları Tur. Sey. Taş. Tic. Ltd. Şti.’s doğadayiz.net e-organization (which will be referred to briefly as Doğadayız in this agreement), and on the other side, the Participant who purchases the organization.

This agreement is valid for the period from the date of booking until the end date of the purchased organization. The products are offered for sale together with all their details through the www.dogadayiz.net website. 

1 – BOOKING

1.1 – When the booking that the Participant makes through our website is completed, the Participant receives an e-mail containing the program information at the e-mail address stated on the booking form. The duration of the service is provided on the dates purchased by the participant.

1.2 – In bookings created with the advance payment method, the remaining payments are collected at the hotel or at the activity area, in cash or by EFT/Bank Transfer. 

1.3 –In the event that the participant does not attend the activity for any reason or does not notify this 24 hours in advance, there is no right to the service.
 

2 – TRANSFERS

2.1 –In our scuba diving, rafting and canyoning day activity tours, we have transfers from Çalış and Fethiye center. Transfers from the Ölüdeniz, Hisarönü and Ovacık region can be provided according to organizational availability. For the boat tour, jeep safari, paragliding and horse safari activities, we have transfers from Fethiye center, Çalış, Ölüdeniz, Hisarönü and Ovacık region. Apart from these regions, transfer service from other regions can be provided according to operational availability.

3 – INCLUDED / NOT INCLUDED SERVICES

3.1 – The activities and services included in the package you have selected are included in the price. No refund may be claimed on account of a service that has not been used.

3.2 – The photographs and videos taken during the activities are not included in the fee. Guests who wish may purchase the photographs and videos after the activity (photo and video shooting is not carried out in the boat tour activity). The image qualities and the devices used for the shooting are accepted by the participant as they are, within the available means and conditions.

4 – CONDITIONS OF PARTICIPATION

4.1 – In the scuba diving activity, the minimum legal age limit is 12; in the rafting activity, the minimum legal age limit is 18. Persons who are within the age limit, who are healthy, who are able to carry out their daily activities and who have no physical or mental problem preventing them from performing the activities may participate.

5 – RISKS AND RESPONSIBILITIES

5.1 – As is the case in all nature sports, in all activities to be carried out such as paragliding, rafting, scuba diving, jeep safari, canyoning, windsurfing, boat tour, ATV safari, horse safari, canoeing and the like; the participants have accepted this agreement knowing that there are certain risks inherent in the nature of nature sports and extreme sports, that accidents of a foreseeable or unforeseeable kind may be experienced, that adverse situations may occur and that, in connection with all of these, there is a possibility of suffering psychological or physical harm.

5.2 – It is accepted that, in the digital service agreement sent, after the participants have made their purchase, to the email address they stated during the booking, they have read and understood this information conveyed by Doğadayız and have decided of their own free will to participate in this organization.

5.3 – They know that, on account of the damage that will arise in the event that they suffer harm from possible foreseeable or unforeseeable accident situations, they may benefit only from the rights granted to the participants within the scope of the activity insurance policies taken out by Doğadayız, and that their treatment may be carried out only by the health institutions with which the insurance company has an agreement and within the stated scope. They know that, for situations other than this, they may, as a precaution, if they wish, take out an extended domestic travel health insurance policy of their own.

5.4 – In all activities; the participants accept that they will use every kind of vehicle, material and equipment provided to them for the performance of the activities within the framework of the safety rules and in a manner appropriate to its purpose. The participant is personally responsible for the adverse events that occur because of acting contrary to the safety rules. In this case, the participant will not be able to benefit from the insurance rights and coverage. Doğadayız is not responsible for any material or moral damage that may arise.

In the event that this equipment provided to the participants is damaged or lost, the material damage that will arise belongs to the participants.

5.5 – Persons are obliged to comply with the activity times and with the safety rules stated in the activities.

Doğadayız Organization shows the necessary care by taking the necessary precautions and measures in order to minimize the accidents that may occur during the activities it provides.  Each of our participants who take part in the organization is informed, within the scope of their free will, about the risks that may arise in nature sports. With the signing of this agreement by the participant, the participants accept and declare that the participant has read and understood the agreement.

6 – RIGHT OF CANCELLATION-REFUND AND DATE CHANGE

In the event of cancellations and refunds for any reason, persons are obliged to notify the agency by e-mail. If the participant notifies, up to 1 day before the start of the organization, via WhatsApp from our contact number 05413368589, that they will not be able to attend the organization;
 

6.1 – Right of Cancellation and Refund:  The participant may cancel and receive a refund of  100% of the amount they have paid. Depending on the type of payment made, the refund is made to the account of the person who made the payment within 2-15 business days.

8.2 – Right of Date Change: The participant may postpone their right to another date within the same season. In the event that the person makes a date change, the price difference between the two periods subject to the change is determined on the basis of the prices applicable on the date on which the person made the booking. If the participant wishes to use this right on a date with the same price, they do not pay any difference. In the event that they use it on a date with a higher price, they pay the price difference between them. However, in the event that they choose a date with a lower price, no refund is made.

8.3 – Right of Transfer to Another Person: The participant may transfer the organization right they have purchased to another person. The person to whom it is transferred may receive the service after reading and signing the agreement.

The rights are applied only 1 time. 
 

7 – RIGHT OF CANCELLATION OF THE AGENCY – FORCE MAJEURE CASES

7.1 – The force majeure cases set out in the laws; the cases that arise because of events of an extraordinary and/or unforeseeable nature despite all due care having been shown and all measures having been taken, and that constitute an obstacle to the commencement, the continuation or the completion of the package tour; the cases in which Doğadayız has no effect whatsoever on the event that has arisen; are deemed force majeure for Doğadayız and the Participant.

These cases are;
